Process of Incorporation for a Software Startup

Hi all!

I know this isn't necessarily coding related, but I was wondering if anyone has gone through the process of incorporating a software startup.

I do not have the software developed yet, but I would like to take the next steps in forming a business. Do I need just state trademarks and articles of incorporation, or do I need to look at federal stuff? Obviously if things go as planned, the software would actually end up being used nationwide, somehow in the process. So what do I do, do I file a state trademark and fictitious name article for my name and mark?
